These Terms of Service (“Terms”) govern your use of Artyfacts (“Artyfacts,” “we,” “us,” or “our”) and our websites, applications, and related services (the “Service”).

1. Acceptance of Terms

By uploading, hosting, or accessing content on the Service, you agree to comply with these Terms. We reserve the right to modify these Terms at any time. Continued use of the Service constitutes acceptance of any changes.

2. Prohibited Content Policy

We are committed to maintaining the Service free of hate speech, discrimination, and harassment. You may not host or share any content that:

• Contains hate speech, slurs, or dehumanizing language targeting people based on race, ethnicity, national origin, color, religion, disability, sexual orientation, gender identity, or immigration status.
• Promotes discrimination, prejudice, or violence against protected groups or individuals.
• Contains homophobic, transphobic, or otherwise bigoted language or imagery intended to demean or dehumanize LGBTQ+ individuals.
• Incites, glorifies, or encourages violence or harassment based on any protected characteristic.
• Consists of conspiracy theories or misinformation specifically designed to dehumanize, mock, or incite action against protected groups.
• Violates applicable laws regarding discrimination, hate crimes, or harassment in the jurisdictions where we operate.

3. Enforcement and Removal

Upon detection or verified reporting of prohibited content, we will take the following immediate actions:

• Remove all prohibited content from the Service without notice or opportunity to appeal.
• Immediately terminate the account of any user who hosts prohibited content.
• Implement account-level bans to prevent the same user from creating replacement accounts.
• Report violations to law enforcement when we determine content may violate applicable hate crime, discrimination, or harassment laws.
• Cooperate fully with law enforcement and provide relevant account data as required by valid legal process.

We actively monitor for prohibited content and encourage users to report violations via our reporting system. Reports will be reviewed and acted upon within 24 hours.

4. Reporting Hateful or Discriminatory Content

Users who encounter prohibited content can report it by submitting a report form with the content URL and details of the violation. All reports will be reviewed by our moderation team and acted upon immediately upon verification.

5. Safe Harbor and Limitation of Liability

Our liability for user-generated content is limited as follows:

• We act as a neutral platform provider. Our role is to host content URLs and provide access mechanisms, not to review, monitor, or approve content before it is uploaded by users.
• We do not assume liability for user-generated content. Users are solely responsible for any content they host on the Service.
• Upon receiving notice of infringing, defamatory, or illegal content (including prohibited hateful content), we respond expeditiously by removing or blocking access to the content.
• We do not knowingly facilitate or enable the hosting of prohibited content, and we implement zero-tolerance removal and account termination for violations.
• Third parties harmed by prohibited content may seek remedies directly from the user who uploaded the content. We will cooperate with law enforcement and provide account information as required by valid legal process.
• To the fullest extent permitted by law, we are not liable for damages arising from the availability of prohibited content on the Service, provided we act expeditiously to remove such content upon notice.

6. No Affiliation or Endorsement

Hosting content on the Service does not indicate our endorsement of that content. We do not affiliate with, endorse, or support the views expressed in any user-uploaded content.

7. User Indemnification

Users agree to indemnify, defend, and hold harmless Artyfacts, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) user-generated content; (b) violation of these Terms; (c) violation of any applicable law or regulation; (d) infringement of third-party intellectual property rights; or (e) harm caused to third parties by content the user has uploaded.

8. Account Termination

We may terminate your account at any time, with or without notice, if we determine that: (a) you have uploaded prohibited content; (b) you have violated any provision of these Terms; (c) you have engaged in illegal activity; or (d) we determine your account presents a risk to the Service, users, or our brand. Upon termination, all content associated with your account will be removed, and you forfeit all rights to any content previously uploaded.

9. Disclaimers

• The Service is provided “as is.” We make no representations or warranties regarding availability, uninterrupted service, or error-free operation.
• We do not guarantee that prohibited content will be detected or removed before a third party encounters it. We commit to removing such content immediately upon notice.
• To the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by applicable law, our total liability to you for any and all claims arising from or relating to these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is less. This limitation applies regardless of the basis of the claim (contract, tort, strict liability, or otherwise) and whether or not we have been advised of the possibility of such damages.

11. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under or relating to these terms shall be exclusively resolved in the state or federal courts located in Delaware, and you irrevocably consent to the jurisdiction and venue of such courts.
